THIS CONTEST IS INTENDED TO BE CONDUCTED IN FRANCE, THE UNITED ARAB EMIRATES, THE UNITED KINGDOM AND THE UNITED STATES ONLY AND SHALL BE GOVERNED AND CONSTRUED ACCORDING TO FRENCH LAW. NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN A PRIZE. BY ENTERING THIS CONTEST, PARTICIPANT ACCEPTS AND AGREES TO BE BOUND BY THESE TERMS & CONDITIONS, VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. THE INFORMATION THE PARTICIPANT PROVIDES MUST BE TRUTHFUL, COMPLETE, ACCURATE AND IN NO WAY MISLEADING AND WILL ONLY BE USED TO ADMINISTER THE CONTEST IN ACCORDANCE WITH ARTICLE 9 BELOW. ANY QUESTIONS, COMMENTS OR COMPLAINTS REGARDING THE CONTEST MUST BE DIRECTED TO ORGANIZER.

  1. Organizer
    The company L.N.C, société a responsabilité limitée organized under the laws of France registered under number 511 248 981 RCS Paris, having its registered office at 17 rue de la Paix, 75002 Paris, France (hereinafter the "Organizer") is organizing a free contest with no obligation to purchase entitled "PALATINE INGREDIENT QUEST" (hereinafter the "Contest") accessible only on the internet from the page https://next.journee.live/themarlyquest (hereinafter the "Website") and promoted on the Organizer's social networks.
    In this respect, Participants are reminded that the Contest is not associated with, managed or sponsored by Instagram, Facebook, TikTok, and that those who participate and meet the conditions described in Article 3 will provide information only to the Organizer and not to these social networks.
  1. Duration of the Contest
    The Contest starts on September 3, 2024 at 00:01am and ends on October 9, 2024 at 11:59pm (date and time of connection in Paris as proof) (the “Duration”).
  1. Conditions of participation in the Contest
    • Participation in the Contest implies unreserved acceptance of these terms & conditions in their entirety (hereinafter the "Terms & Conditions"), as well as the laws and regulations in force in France applicable to this Contest. Failure to comply with the conditions of participation set out in the Terms & Conditions will result in the nullity of the participation in question.
    • Participation in the Contest is reserved for any natural person of legal age residing in France, United Kingdom, United States of America or United Arab Emirates.
    • Persons who have participated, directly or indirectly and in any capacity whatsoever, in the development and implementation of the Contest are excluded from any participation in this Contest (in particular the representatives and employees of the Organizer and its service providers including their representatives - same name and postal address).
    • Only participants that comply with all the provisions of the Terms & Conditions will be retained (the “Participants”). In this respect, the Organizer reserves the right to request any justification regarding the age of each Participant. Any incomplete, erroneous or falsified information will result in the disqualification of the Participant for the Contest.
    • Any fraud, or attempted fraud, non-compliance with the Terms & Conditions, or any malicious intention to disrupt the running of the Contest, may give rise to the disqualification of its author, the Organizer reserving the right to initiate legal proceedings against him.
      Similarly, if it is proven that the course of the Contest is disrupted by third parties, but that a Participant is a co-author or accomplice of these acts, his/her participation will also be considered null and void and legal proceedings may be initiated by the Organizer against such Participant.
  1. Terms and conditions of the Contest
    • Participation in the Contest is carried out exclusively via the internet (fixed or mobile) on the Website according to the terms and conditions described below.
    • To play, each Participant must, during the Duration of the Contest:
      • Log in to the Website directly or through links included in posts on the social media channels of the Organizer’s brand; and
      • Search on the interactive map of the Chateau de Marly (online from the beginning of the Contest) for the twelve (12) ingredients of the new fragrance “Palatine” to collect them as fast as possible by opening the pins arranged at various points of the Chateau de Marly.
  1. Methods of designation and information of the Winners
    • Throughout the Duration of the Contest, Participants will be ranked according to the total time elapsed from the first connection to the collection of the last ingredient. The ranking will be recorded by the external service provider in charge of the management of the Contest, Timescope.
    • At the end of the Contest, the first twelve (12) Participants of the ranking worldwide will be designated the winners (each a “Winner”).
    • Each Winner will win one (1) 75ml PALATINE perfume bottle, worth EUR 260 (the “Prize”).
    • The Winners will be contacted by e-mail within seven (7) days of the end of the Contest.
    • The Winners must, within a maximum period of eight (8) working days following this email, confirm by return email that they accept their Prize and indicate their contact details necessary for the delivery of their Prize: surname, first name, postal address, telephone number and date of birth, attaching a copy of a valid identity document.
    • In the absence of a response from a Winner within the above-mentioned conditions and deadlines or in the event of a Winner's express renunciation of the Price, the Prize will be considered lost for the Winner. Such Prize will then remain the property of the Organizer and will not give rise to any compensation or consideration.
  2. Terms and conditions for the delivery and use of the Prizes
    • After receipt of the Winners' contact details under the conditions specified in Article 5.5 above, the Organizer will send the Prizes to the said Winner to the postal address they have communicated.
    • In the event of the provision of incomplete or inaccurate contact details that do not enable the designated Winner to obtain his/her Prize, the latter will remain the property of the Organizer.
    • The Organizer will not be held liable for delays and/or losses during shipment due to postal services, nor for the total or partial destruction of the Prize during transport. Similarly, any Prize not received on the first delivery to the Winner by the postal services will be lost for the Winner and will remain the property of the Organizer. In general, the Organizer cannot be held liable for any damage, theft or loss occurring during the shipment and delivery of the Prizes.
    • Each Prize allocated is strictly personal and cannot be transferred to any third party; it may not be reimbursed in cash or exchanged or remitted of its total or partial equivalent, in kind or in cash, by the Organizer.
    • In the event of force majeure as defined by law or events beyond its control, the Organizer reserves the right to replace the Prize with a prize of equivalent value and/or similar characteristics.
  3. Consultation of the Regulations

    • The Terms & Conditions shall also be sent, at no charge, to anyone requesting them from the Organizer.
  1. Amendments to the Terms & Conditions
    • The Organizer reserves the right, at any time and without notice or obligation to justify its decision, to shorten, extend, postpone or cancel the Contest as well as to amend the Terms & Conditions, with no compensation and without its liability being engaged.
    • In such event, the Organizer will make its best efforts to inform the Participants shortly, it being understood that any amendment of the Terms & Conditions (except in the event of cancellation of the Contest) will come into force as soon as it is put online (date and time in France as proof).
    • All Participants will then be deemed to have accepted such amendment simply by participating in the Contest from the date of entry into force of the said amendment. Any person who refuses the amendment made must refrain from participating in the Contest.
  2. Personal data
    • Participants authorize the collect, process, use and storage of the following categories of data:
      • Data relating to connection, use of services and interaction: Answers to the Contest, time of connection to the Contest,
      • Last name, first name,
      • Email address,
      • For Winners only, in addition to the above: postal address, telephone number, date of birth and copy of an identity document.
    • The data collected in the context of the Contest is necessary to allow the Organizer to manage participation in the Contest, to inform the winners, to manage the delivery of the prizes to the said winners and with their specific consent (Opt-In), for commercial prospect by the Organizer or its affiliates.
    • The personal data is processed in accordance with the provisions of the French Data Protection Act No. 78-17 of 6 January 1978, as amended, and the General Data Protection Regulation (GDPR).
    • The personal data collected will be held only for as long as necessary to achieve the purpose for which such personal data is held, to answer Participants’ question or to allow the Organizer to fulfil its legal obligations:
      • For all Participants: personal data is held for the duration of the Contest and the time required to distribute the Prizes;
      • In the event of a Participant’s request related to the Contest: personal data is held for as long as necessary to process the request;
      • In case of specific consent to receive commercial prospecting messages, personal data will be kept until the Participant unsubscribes or asks the Organizer to delete it, or until a period of inactivity (no active interaction with the brand) has elapsed in accordance with applicable regulations.
    • Each Participant has the right to access, rectify, delete and withdraw data concerning him or her by writing to the Organizer, at any time by sending a letter with a copy of identity document a to L.N.C, 17 rue de la Paix, 75002 Paris or the following e-mail address customerservice@pmarly.com.
    • Participants who exercise their right to have their personal data deleted before the end of the Contest will be deemed to have waived their right to participate.
    1. Responsibilities
      • The liability of the Organizer is strictly limited to the delivery of the Prizes actually and validly won.
      • It is expressly recalled that the Internet is not a secure network. In this respect, participation in the Contest implies the knowledge and acceptance, by any Participant, of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet in general and on the social networks in particular, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses on the Internet.
      • Consequently, the Organizer cannot be held responsible in particular for contamination by any viruses or the intrusion of a third party into the system of the terminal of the Participants in the Contest and declines all responsibility for the consequences of the Participants' connection to the Website.
      • In particular, the Organizer cannot be held liable for any damage caused to the Participants, their computer equipment and the data stored therein, as well as the consequences that may result from this on their personal or professional activity. It is the responsibility of each Participant to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any infringement. The connection of any person and his/her participation in the Contest is done under his or her sole responsibility.
      • The Organizer cannot be held responsible in the event that one or more Participants are unable to connect to social networks or the Website, or to play due to any problem or technical defect related in particular to network congestion.
      • The Organizer cannot be held liable for any damage caused to third parties or to the rights of third parties by the Participants. Given the characteristics of the Internet, such as the free capture of the information disseminated and the difficulty, or even the impossibility, of controlling the use that could be made of it without its knowledge by third parties, the Organizer cannot be held responsible for any fraudulent use of the rights of connection or attribution of a Prize, unless the existence of a fault on its part is demonstrated.
      • The Organizer may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular by computer means in the context of participation in the Contest or the determination of the Winners. In this case, it reserves the right not to award the Prize to fraudsters and/or to prosecute the perpetrators of these frauds before the competent courts. However, it cannot incur any liability of any kind towards the Participants as a result of any fraud that may have been committed.
      • The Organizer will make its best efforts to allow access to the Contest at any time on the Website, and on the dedicated publication, without being bound by any obligation to do so. The Organizer may, at any time, in particular for technical reasons or for reasons of update or maintenance, interrupt access to the publication of the Contest on the Site. The Organizer will not be responsible for these interruptions and their consequences.
    2. Agreement of evidence
      • The Organizer has put in place the necessary technical means to demonstrate the participation or non-participation of a Participant. It is therefore agreed that, except in the case of a manifest error, the data contained in the information systems of Timescope have probative value with regard to the connection elements and the information of a computer processing relating to the Contest.
      • Thus, except in the event of a manifest error, the Organizer may rely, in particular for the purposes of proving any act, fact or omission, on programs, data, files, records, operations and other elements (such as monitoring reports or other statements) of a nature or in computer or electronic format or medium, established, received or stored directly or indirectly by the Organizer, particularly in Timescope’s information systems.
    3. Force majeure
      • The Organizer cannot be held liable, in general, in the event of force majeure or fortuitous events beyond its control (in particular a health risk or technical problems, etc.) disrupting the organization and management of the Contest, so that it may be shortened, extended, postponed, modified or cancelled.
      • Force majeure is any unforeseen, insurmountable event beyond the control of a person likely to relieve him or her of liability or release him or her from his or her commitments, according to article 1218 of the French Civil Code.
    4. Complaints
      • In the event of a dispute or claim, for any reason whatsoever, requests must be sent to the Organizer within two months of the end of the Contest by post (postmarked as proof) to the Organizer's address (L.N.C, 17 rue de la Paix, 75002 Paris) or the following e-mail address customerservice@pmarly.com.
      • No telephone requests will be answered.
    5. Miscellaneous
      • If one or more provisions of the Regulations are declared null and/or not applicable, the other clauses will retain their full force and scope.
      • These Terms & Conditions are subject to French law.
      • Any dispute arising during the Contest and which cannot be settled amicably will be submitted to the French competent courts.

    The shelf life begins with the first spray. Once the scent has been introduced to air, allowing for 3 years shelf life if it is stored properly.
